Whilst we will make every effort to ensure that our websites and web applications are free of errors, we will not accept responsibility for any losses incurred due to the malfunctioning of our software or any part of it. We are not liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines. We are not responsible for problems arising from modifications made to your website and/or web app made by you or a 3rd party.
Once you have viewed and approved your website Fountain Digital Ltd will make the website live for public viewing. If after this time you wish to make any alterations to the website then inclusive of your monthly website rental fee is the ability to request unlimited minor amendments and updates to your website*, minor amendments are inclusive of the following:
Please note minor amendments do not include changes to graphical design, website layout and additional pages. Alterations to graphical design and website layout will incur an additional fee. A quotation can be provided by us upon request.
If you go over your agreed amount of website pages in your agreement/contract you will need to upgrade your website package to the next tier, please contact us on 01323 887387 for more information.
We will not carry out any works until you have provided us with all the website copy/content, images and website menu items. We will not provide any copy writing services or stock images for your website. These services can be purchased additionally upon request for a set fee.
Website Rental CMS (Content Management System) and static websites without a CMS (Content Management System) unlimited website amendments and updates are subject to our fair usage policy.
We require fees, set out in the signed agreement signed by you to be paid by Direct Debit per calendar month. If a payment fails or has not been made we reserve the right to suspend all services hosted by us with immediate effect. Once any outstanding invoices or payments have been paid in full we will resume all services.

The minimum period for your contract is stated in your signed agreement. If you terminate the agreement or contract between you and us before the end of the agreed signed agreement or contract term you will be required to pay the full remaining outstanding balance in full.
If there is a delay in receiving all required information within 3 months, which prevents your site from being made live, your monthly payments for the contract will automatically start on the third month from the signed contract via Direct Debit.
After your agreement or contract term your agreement or contract will automatically be renewed on a rolling one month contract, if you wish to terminate your one month rolling contract we require one month’s written notice, If you wish to terminate your website contract before the one months notice period, an additional termination fee will be added to the final invoice.
To reflect supplier costs, Fountain Digital may change the fees charged to you for your services at any time. For packages billed on a monthly subscription basis, the change will become effective only at the end of the then-current monthly billing cycle of your package. Fountain Digital will provide you with advance notice of any change in fees.

Upon receipt of this we will issue your final invoice and the account will then be scheduled for closure as requested.
A rented website or database remains the property of us during the agreement or contract period. If you wish to cancel your agreement or contract after the initial twelve or twenty four months, we will provide you with a monthly or annual hosting fee.
We build all our websites on Webflow and our eCommerce providers are Webflow and Ecwid, Ecwid eCommerce is charged at a separate monthly fee
If you wish to keep all services active after you have cancelled your agreement or contract with us, we will provide you a monthly or annual hosting cost to retain your services.
If you have purchased a website or database outright from us, we will not include any updates, all updates thereafter are charged at a set fee. Annual hosting will also be charged at a set fee.

Our website rental packages do not include any Domain Names, if you require a domain name or names you will be required to purchase these at your own cost. Should we purchase any domain name on your behalf, we will invoice you separately. If you manage your own Domain Names, you are responsibly in managing all DNS settings to point to our servers.

We will make every effort to ensure that any website we develop will function correctly when viewed in all major internet browsers. However, we cannot guarantee a website will correctly function with all browser software.
On January 12, 2016 Microsoft announced end of support for: IE10, IE9, and IE8 on Windows 7,Windows 8.1, and Windows 10. Internet Explorer 11 is now the last version of Internet Explorer on these platforms. If you are still using any of these outdated browser platforms, then you are putting your computer system and networks at risk of malware and cyber attacks.

We will not accept responsibility for any copyright infringement caused by materials submitted by you. We reserve the right to refuse to use any copyrighted material unless you provide us with proof that you have permission to use such material.

We can not and will not guarantee any page rank position or any loss of the page ranks indexed by search engine providers.
SEO - Search Engine Optimisation & Hosting
If your current website plan is on "Startup" and you terminate your SEO "Search Engine Optimisation" contract you will be automatically upgraded to "Business" & charged an extra £30+vat pm to cover the CMS hosting which controls the SEO "Search Engine Optimisation Landing Pages & Collections, if you choose to remove the CMS Hosting this will remove any Landing Pages created along with any CMS items, Example: Blogs, Case Study's, News collections. Whilst an active SEO "Search Engine Optimisation" plan is in place, you will not be charged the additional £20+vat.
If CMS collections are removed this will impact your SEO "Search Engine Optimisation" rankings on search engines. If your current plan is on Business or Business Pro you will not be affected by this.
We can not grant any 3rd party SEO companies access into our Webflow team plans for security purposes.
We can not grant any 3rd party SEO "Search Engine Optimisation" companies admin access to certain backend technical elements within the website for security purposes, this will encounter additional costs by us to carry out additional technical SEO "Search Engine Optimisation" works as these are not covered by your monthly website plan.
You can purchase or subscribe to additional SEO "Search Engine Optimisation" packages from us at any time.
We only offer website hosting for websites we have created.
We will endeavour to maintain a continuous service. However, you accept that server downtime, whether for system upgrades or any other reason, may occur. We will not be liable for any period of downtime or data loss and there will be no compensation paid. We are not responsible for any losses resulting from acts of god or force majeure including civil unrest, riots, floods, drought, fire, war and imposing legislation.

The only personal information we hold about you and your business is your name, address, contact details and the names of websites we host for you. If required please ask to see our Data Protection Policy.

By subscribing to an account with us and your continued use of our services means that you agree to be bound by these terms and conditions. These terms and conditions apply to all accounts you have with us. Multiple domains may not be hosted on a single account. Sub domains (where provided) may be used as an extension of the main website. Sub domains may not be used to host additional websites. Any domain names that are forwarded to a website hosted by us or added (using either another provider forwarding service or the Add on or Parked domains feature in the control panel) must belong to the account holder.
You are solely accountable for any loss or inability to retrieve your Website Content resulting from hosting on our Platform. We strongly recommend that you regularly backup and/or archive your Website Content. Please note that we are not obligated to create backup copies or archive your Website Content on your behalf.

If your account exceeds its monthly bandwidth limit, we will inform you. If you do not wish to purchase extra bandwidth or upgrade your account and continue to exceed the limit, the account will be suspended until you have increased your monthly bandwidth limit.

You are responsible for any misuse of your account and you must take steps to ensure that others do not gain unauthorised access to your account. Your password provides access to your account and it is your responsibility to keep your password secure. Sharing your password and account access with unauthorised users is strictly prohibited. An account provided by us may only be used for lawful purposes. Use of our account to infringe upon any copyright, patent or trademark is prohibited. This includes but is not limited to the offer of sale of any counterfeit merchandise of a trademark holder, unauthorised copying of music, books, photographs, or any other copyrighted work.We reserve the right to suspend or terminate an account immediately in the event of an infringement or suspected infringement (as defined in the preceding paragraph) by you. We also have the right to suspend any account immediately if there is a legal dispute concerning any of the content on your website. You must check all content provided and written by us. If we have written any articles/news/blogs and referenced any sources you must check all references within these articles/news/blogs at all times. We are not liable for any inaccurate content or reference sources used. You must approve and check all content & reference sources before they are placed on your website.
We do not permit you to use your account to display on a website or otherwise disseminate any ofthe following content:

We shall provide, or procure the provision of the Services to you as set out in the agreement. We will use reasonable endeavours to provide all services promptly. All dates or times quoted for commencement or completion of any part of the services are estimates only. Services may be provided onsite or remotely via your internet connection or by telephone, at our sole option. Where, in our sole and reasonable opinion, it is necessary and/or desirable for you to install remote support software, such software will be provided by us. We shall be entitled to make variations and additions to the services from time to time, acting reasonably, for operational reasons (provided that these do not materially, adversely affect the Services), to comply with any legal or regulatory obligation or for any other reason.
Without prejudice to us other remedies, we may suspend all or part of the services without prior notice if we reasonably believe the circumstances justify this to protect itself or others, to comply with any law, where you have failed to pay any charges, or if any events occur which would entitle us to terminate this agreement. In making the decision to suspend the services, we are not obliged to consider the cost or damage to you that may be caused by suspension of the services to you. We may also suspend all or part of the Services to carry out maintenance where, in our reasonable opinion, it is necessary or desirable to do so. In such an event, we shall provide you with as much prior notice as is reasonably practicable.
The Customer shall act in accordance with the provisions of the Data Protection Act 1998 and all other applicable data protection legislation at all times. You and us acknowledge and agree that the you are the data controller and we are the data processor in respect of all personal data of your personnel (as such terms are defined in the Data Protection Act 1998). You therefore confirms that it is solely responsible for ensuring that any data processing and security obligations that arise from the provision of the Services comply with applicable data protection law. We will only process personal data for the purposes of providing you with the services. We have in place and will maintain for the duration of these terms and conditions appropriate technical and organisational measures against the accidental, unauthorised or unlawful processing, destruction, or disclosure of personal data and adequate security programmes and procedures to ensure that unauthorised persons do not have access to any equipment used to process personal data.
Website Contact Form Submissions
We are unable to guarantee form submission delivery as there are many variables that can affect whether the email notification can reach an inbox after it is sent out. This is not something specific to Fountain Digital Ltd but email delivery is an area that many hosting companies are continually trying to help customers to manage. We strongly advise that you test your website contact forms by submitting a test submission to make sure you receive the email test, we would advise that this is tested on a weekly basis. Contact Forms
We provide all websites with one basic contact form containing fields: Name, Number, Email, Comments. Should you require a more bespoke form integration to be designed and built we will quote accordingly for theses works to be carried out.
Email Hosting - UPDATED 2 September 2023
Zimbra 8.8. 15 Open Source Edition is approaching its end-of-life (EOL), which means that support, security patches, and updates will only be available until December 31, 2023
All legacy website customers which included 2/3 Zimbra email accounts as part of the package, this will no longer be available for free and you will be automatically enrolled onto Microsoft 365 Business Basic plan. (Annually but charged monthly) this will keep your monthly cost to a minimum. Any Zimbra accounts that are charged separately, the mailbox prices will be automatically adjusted per calendar month accordingly.
We provide hosted instances of Zimbra Email Collaboration Solution, setting up, administering, and provision of end-user accounts within the service is carried out online via an administration portal. The physical infrastructure within the cloud computing platform is a shared environment. The Service is provided centrally from our servers and the platforms are connected to the Internet. You are responsible for providing connectivity between your premises and our servers. Our email platform is based on Zimbra Community Edition, calendar and collaboration solution. Specific software versions may change from time to time. You will be provided with the agreed GB size of space for which you will be charged a monthly recurring fee and these charges will apply regardless of whether you allocate the mailboxes to your end users.The Service is over HTTPS Web Services/ ActiveSync Enabled. This Service enables end users to access email, contacts and calendar entries via the internet using a secure web browser. If you change your DNS settings on your current domain name or requested that these are changed to be pointed to another email provider we will no longer backup any email accounts and the mailboxes will be scheduled for closer within 24hrs, All personal data will then be removed from our servers. We do not support any connecting third-party software, Example “Microsoft Outlook, Thunderbird, Sage” to connect to our platforms or servers.
Our servers are configured to backup every day. Your data and emails are not guaranteed to be backed up correctly without errors.
It is solely your responsibility to ensure your data is being correctly backed up and securely and stored offsite.
We will not take any responsibility for any failed backups or data loss or corruption.

Our eCommerce platform are built on Webflow and Ecwid. We are resellers of the provided eCommerce platforms.

Webflow eCommerce charges are provided upon request.
We are not responsible for adding new products, categories, shipping, collecting payments or updating existing products.
You as the administer of Webflow or Ecwid are solely responsibly for maintaining your eCommerce platforms.
We will install & setup Ecwid with a total of no more than 5 test categories and 2 products per category.
We will provide training, support and technical assistance if required.
SEO & Marketing packages, please refer to your signed SEO Marketing agreement to see which packages your contract refers too. All SEO & Marketing packages are either three months or six months contracts, after the contract you can give one month’s written notice and we will then close the account. If you do not cancel your agreement your contract will be renewed every month. We have the right to terminate the contract if you are not able to communicate with us regarding your campaign or if no payment is made. Running paid campaigns, We will pay the fee’s directly to Instagram, Facebook and LinkedIn on a monthly basis and will invoice you directly for these charges, Ad spend charges are separate from your SEO & Marketing contract. We cannot guarantee any ranking positions within search engines over the full agreed contract term.
Website Reviews & Audits
You have the flexibility to cancel your subscription at any time. However, please note that depending on the product and the type of subscription you have, there may be a penalty for canceling before the end of your contract. There is no penalty for canceling your contract at any time for subscriptions with a monthly commitment payment.
If you decide to cancel an annual commitment subscription that is paid on a month-to-month basis, there may be penalties involved.
